**Terrace On Main Street Vacation Rental House Rules Agreement**

Welcome to Terrace on Main Street! We hope you have a wonderful stay at our vacation rental. To ensure a pleasant experience for all guests, we kindly ask you to adhere to the following house rules:

~Please be aware there are tenants who have retail space in the downstairs area and operate normal business hours. We ask for your courtesy and respect during your stay.

~Service animals are allowed, so long as written permission is provided prior to your stay by the owner.

~There is a strict NO PET POLICY.  Should the hospitality crew find during your stay that you have violated this policy, there will be a minimum $250.00 non-refundable fee added to your stay.  This is not a pet friendly condo. There is no direct access to allow your pet to pottie or otherwise do their “thing”.  We love our pets as much or more than anyone.  We’ve just found it difficult for our pets to vacation here with us.

~We simply ask for you to report any conspicuous damage immediately to the owner which ensued because of your stay with us enabling our hospitality crew to address your concerns as quickly as possible.

~No "Events" allowed on the premises.

~We want you to enjoy our Smart TVs. However, should our Hospitality crew encounter damage because of your negligence, OR the removal or loss of an assigned remote, you will be charged no less than a non-refundable fee of $150.00 for repair and or replacement.

-There is limited parking available at the rear of the premises and is provided on a non-reserved basis. There is a drop off zone near the entrance. Street parking is available throughout the village. Upon arrival at the location, the front door is marked as Suite E in the rear of the building at ground level and is a sage colored door with 4 split windows and the security number pad where you will enter your security code sent under separate cover.

1. **Check-in and Check-out: **

- Check-in time is 3:00 PM, and check-out time is 11:00 AM.

- Early check-in or late check-out may be accommodated upon request, subject to availability.

2. **Smoking: **

- Smoking is strictly prohibited inside the property.

3. **Quiet Hours: **

- Please respect quiet hours between 10:00 PM and 8:00 AM.

- Keep noise levels to a minimum, especially in shared spaces. Please be aware there are tenants who have retail space in the downstairs area and operate normal business hours. We ask for your courtesy and respect during your stay.

4. **Parties and Events: **

- Parties and events are not allowed and strictly prohibited without prior written approval from the management and are subject to non-refundable fees should they be approved.

- Please be considerate of neighbors and other guests.

5. **Guest Limit: **

- The maximum number of guests is specified in your reservation at six (6). Additional guests are not allowed without prior written approval and subject to an additional $50.00/ guest minimum non-refundable fee should approval be granted.

6. **Damages: **

- Guests are responsible for any damage caused to the property and its contents during their stay.

- Report any damage or issues immediately to the property management. There will be a $250.00 refundable fee (to be refunded within seven (7) days of your departure) should the premises upon departure remain in the same condition as when you arrived.

**Remember, in an effort to protect both parties, our Hospitality Crew members take photos of the property before and after your arrival and departure. **

7. **Kitchen Use: **

- Please clean up after using the kitchen and appliances.

- Dispose of garbage in the provided bins.

8. **Respect for Property: **

- Please treat the property and its belongings with care and respect.

- Do not rearrange the furniture.

9. **Security and Safety: **

- Lock all doors and windows when leaving the property.

- Report any security concerns to the property management immediately. Upon your departure your keypad security PIN will be deleted. Not to worry, if you leave anything, our Hospitality Crew will do their best to contact you regarding it’s safe return. Please be aware that for your safety and that of your guests, the condo has a security camera doorbell outside the front door. For your privacy, there are no other cameras located within the condo.

10. **Parking: **

- There is limited parking available at the rear of the premises and is provided on a non-reserved basis. There is a drop off zone near the entrance. There is a handicap parking spot on a first come basis located at the rear parking area. Street parking is available throughout the village. Upon arrival at the location, the front door is marked as Suite E in the rear of the building at ground level and is a sage colored door with 4 split windows and the security number pad where you will enter your security code sent under separate cover.

11. **Wi-Fi and Technology: **

- Use of the private provided Wi-Fi is subject to our acceptable use policy and instructions will be provided upon affirmation of your reservation.

- Please follow any specific instructions for technology use on the property. Each room is equipped with a Smart TV for your enjoyment. However, should a dedicated remote become lost, damaged, or missing, there will be a $150.00 non-refundable fee per remote.

12. **Liability Exclusion and Hold Harmless Agreement**

Please be advised that the owners of this vacation rental are not responsible for any theft or damage to tenants' personal belongings during their stay. We highly recommend that guests secure their valuables and exercise caution with their possessions. In addition, by occupying the rental property, tenants agree to hold the owners harmless from any claims, liabilities, costs, or expenses arising from theft or damage to personal belongings. While we strive to provide a safe and enjoyable environment, it is essential for tenants to take appropriate measures to safeguard their belongings.

**Liability Exclusion: **

The Tenant and their guest(s) acknowledge and agrees that coverage does not exist for any bodily injury or property damage claims arising out of or related to any of the following circumstances:

1. The Tenant causing or contributing to the intoxication of any person, whether by the provision of alcohol or any other substance, legal or otherwise.

2. The Tenant furnishing alcoholic beverages to a minor or to any person under the influence of alcohol.

3. Any violation of laws while under the influence of alcohol or any other intoxicating substance by the Tenant.

**Hold Harmless Agreement: **

The Tenant and their guest(s) agree to indemnify, defend, and hold harmless the Indemnified Party (Owner) from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the aforementioned excluded circumstances.

The Tenant and their guest(s) further agree to assume full responsibility for any legal consequences, financial obligations, or other liabilities resulting from their actions, including but not limited to those leading to bodily injury or property damage due to intoxication, provision of alcoholic beverages to minors or persons under the influence, or violations of laws under the influence of alcohol or any other substance.

13. **Security Deposit **

A pre-authorization of $250 is held on 1 day before arrival and voided on 7 days after departure.

We understand there are circumstances which are out of your control and may become subject to inquiry!

A Late Check-Out option may become available upon request. Should it become available, there will be a one-time, non-refundable fee of $50.00 charged to your stay. Late Check-Out time extends to two (2) hours past the posted time, or 1:00pm, whichever is less, or otherwise a time agreed upon in advance, depending upon availability.

An Early Check-In option may become available upon request. Should it become available, there will be a one-time, non-refundable fee of $50.00 charged to your stay. Early Check-In may be no earlier than 2 hours prior to your agreed upon check-in time, or otherwise a time agreed upon in advance, depending upon availability.

**Acknowledgment: **

By entering into a nightly rental agreement, the Tenant and their guest(s) automatically acknowledge that they have read, understand, and agree to the terms of this Liability Exclusion and Hold Harmless Agreement and RULES of the HOUSE. The Tenant and their guest(s) further acknowledge that any claims falling within the specified exclusions are not covered by the Owners insurance policy, and they assume all liability for the consequences arising from such actions.

This Agreement shall be effective as of the date the Tenant entering into a Nightly Rental Agreement and Contract to Rent with the Owner or its management delegate and shall remain in full force until terminated by mutual written agreement of both parties, and the Contract to Rent has been terminated.

By booking Terrace on Main Street, you agree to abide by these house rules. Failure to comply may result in additional charges or eviction without a refund and the exercise of enforcement upon the Tenant by any means necessary. Thank you for your cooperation, and we hope you enjoy your stay!

**Rates, terms, and fees are subject to change without notice. **

This Agreement, [and any exhibits attached hereto,] is the entire, final, complete, and fully integrated agreement between the Parties with respect to the subject matter hereof and supersedes any prior agreements or communications between the Parties, whether written, oral, electronic or otherwise.
